This Data Protection Notice applies to your use of this website and all applications, services and products available through this website (collectively the "RapMed Service") and describes how Rapid Medicine GmbH, Seerosenstrasse 3, CH - 8008 Zurich, Switzerland ("we", "our" or "us") process your personal data.

The term "personal data" means any information relating to an identified or identifiable natural person.

The terms "process" and "processing" mean any operation which is performed on personal data, regardless of the means and procedures used, such as collection, storage, use, alteration, disclosure, archiving, erasure, or destruction.

2. Who is responsible for processing your personal data?

Rapid Medicine GmbH, Seerosenstrasse 3, CH - 8008 Zurich, Switzerland is the controller that determines the purposes and means of the processing of personal data.

3. For what purposes and on what legal bases do we process personal data?

3.1 Processing purposes in general

We process personal data when you use the RapMed Service; when you open and close an account; when you provide information through the RapMed Service or contact us otherwise; to give access to provide, operate, improve and further develop the RapMed Service and its underlying technology, develop new tools and technologies (notably by crowdsourced training of machine learning algorithms); to analyse the use of the RapMed Service; to detect, investigate and ward off attacks; to communicate with you; to comply with legal obligations and to defend and enforce legal claims. These general processing purposes are described in more detail below.

3.2 Additional description

We process your personal data for various purposes described in this Data Protection Notice and, to the extent this is required, on various applicable legal bases that permit such processing, such as those set out in the EU General Data Protection Regulation (Regulation (EU) 2016/679; "GDPR"). Depending on the personal data and the purpose for its processing, we notably rely on one or more of the following legal bases: 

Purposes for which we primarily have a legitimate interest

We process personal data in relation to your use of the RapMed Service, in particular your solution proposal to a given problem, and time it takes you to solve the problem in order to be able to provide and further develop and improve the RapMed Service and its underlying technology and develop new tools and technologies (notably by crowdsourced training of machine learning algorithms) for commercial and non-commercial use. We process personal data in relation to your use of the RapMed Service to let some or all other users of the RapMed Service see your solution proposal, resolution time, annotations and comments, and to provide statistics thereof. We process personal data when you access this website or use the RapMed Service

  • to ensure functionality, correct and uniform display of this website and the RapMed Service, their respective contents, services and offers (this includes the use of web fonts and cookies);
  • to optimise the attractiveness and functionality of this website and the RapMed Service, their respective contents, services and offers (this includes the use of web fonts and cookies);
  • to ensure data traffic;
  • to ensure the stability and security of this website and the RapMed Service underlying technology and used systems on a permanent basis (this includes the use of cookies);
  • to enable the detection, defence and investigation of cyberattacks, spam, abuse, identity theft and other unlawful actions in relation to this website and the RapMed Service and systems and to enforce claims in this respect.

We process the personal data you provide upon opening an account, or when you contact us, to respond to you or contact you from time to time in connection with this website and the RapMed Service and your use thereof either directly or through third parties. We may for instance inform you of new features or ask you for input. You may also be contacted for security reasons, notably in case of any (suspected) breaches or threats. We also process personal data to communicate with you in relation to any concerns you may have. 

We process personal data for anonymisation purposes. 

We process personal data in the context of any mergers, acquisitions, divestitures, transfer or pledging of assets, cooperations, participations, partnerships and any similar transactions and relationships. 

We process personal data for the defence and enforcement of legal claims and compliance with applicable laws. 

Purposes for which we will additionally ask for your consent

We process personal data for web analysis purposes. Web analysis gives us access to reports and statistics on this website and the RapMed Service. It notably provides us with information about the activity on and use of this website and the RapMed Service, which sub-pages and contents of this website and the RapMed Service are accessed and how visitors move within and use this website and the RapMed Service. We use this, for instance, to optimise this website and the RapMed Service, adapt them to the needs of the users and increase security. Web analytics services use cookies. We process personal data when you contact us for the purpose of communication with you and handling your request. If you contact us by e-mail or enter your e-mail address in the contact form you acknowledge that you are aware of the risks associated with e-mail transmissions and give your consent that we may also communicate with you by e-mail and exchange data with unencrypted e-mail messages. 

Performance of a contract 

We process personal data for the purpose of negotiating or concluding a contract or in relation to the performance of a contract. This includes precontractual negotiations. For this purpose, we process the information entered by you upon opening an account or at a later time to open, operate, maintain and close your customer account, manage operate and maintain the RapMed Service, manage and grant access to specific areas and parts of the RapMed Service. We process personal data in relation to your use of the RapMed Service, in particular your solution proposal to a given problem, and time it takes you to solve the problem in order to be able to provide the RapMed Service and also to let some or all other users of the RapMed Service see your solution proposal, resolution time, annotations and comments, and to provide statistics thereof. 

Legal obligations

We process your personal data to fulfil a legal obligation to which we are subject to (such as retention requirements) and to exercise specific rights. 

Public interest

We process personal data where this is necessary for the performance of a task carried out in the public interest.

4. Means of contact

On this website and the RapMed Service we may enable you to get in touch with us via contact forms or via contact details provided. When contacting us via a contact form, you will be asked to enter all the necessary information that we need to process the contact and communicate with you. Without this required information we will not be able to communicate with you.

If you use contact forms provided on this website or in the RapMed Service, the information you enter will be encrypted. If you contact us by e-mail or enter your e-mail address in the contact form, we may also communicate with you by e-mail. Please note that our e-mail messages will not be encrypted. Please note further that there are significant risks and dangers to unencrypted data transmission over the Internet, in particular the risk of content corruption, incomplete transmission, errors in the input of the e-mail address and thus delivery to unauthorized third parties, service malfunctions and service interruptions as well as misuse by third parties.

5. Additional information on the use of cookies

We use so-called "cookies" on this website and the RapMed Service. Cookies are small text files that are stored by your browser on your computer or mobile device. They are used to collect certain information while navigating a website and to retrieve it during your current browser session or during future visits. Cookies make it possible to recognize the browser you are using or to temporarily save the entries you have made. Cookies also help us to make our website work or work more efficiently or user-friendly.

7. Additional information on the use of web fonts

Web fonts enable a uniform display of fonts on this website and the RapMed Service and do not require that the corresponding fonts are installed on your device.

This website and the RapMed Service use web fonts provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). When you visit this website and use the RapMed Service, your browser will connect to the servers of Google and load the required web fonts into your browser cache. In the process, Google will obtain knowledge that this website or the RapMed Service has been accessed via your IP address.

8. What personal data do we process?

When you visit this website or access and use the RapMed Service, the web servers that are used collect and store the following general information by default:

  • Your browser and operating system
  • The website from which you visited us (referring website)
  • The websites and webpages which you visit when you are with us
  • The date and time of your visit
  • Your internet service provider
  • Your IP address

When you visit this website or access and use the RapMed Service, we may also collect and store data related to cookies (see also Section 5).

When you open a user account, access and use the RapMed Service, the information that is processed includes but is not limited to the following:

  • Your (user) name
  • Your e-mail address
  • Additional information and content you provide (such as educational institution, location, year of study, course, unit, uploaded DICOM images, and any other information that you enter in any input masks)
  • Sessions
  • Lectures
  • Your solution proposal for a specific case (including time used)
  • Your annotations
  • Your comments

When you open a user account, you will be asked to enter all necessary information. Without this necessary information, we will not be able to open and operate your account.

We also process any information you provide when contacting us either through the RapMed Service or through other means. We notably store or process the information that you enter in the input masks or otherwise communicate to us. When contacting us by e-mail, we notably store the information transmitted with the e-mail. When you contact us, we also store your IP address and the time and date of your contact.

8. What categories of recipients of personal data exist?

Within the scope of the processing or purposes described in this Data Protection Notice, we will - if permitted - transfer personal data to third parties or disclose personal data to such third parties. Third parties, who may process this data for us or for their own purposes or who may take note of it in the course of their work for us, include in particular:

  • (IT) service providers and processors employed or engaged by us (these include, for example, the providers of hosting, storage, operation, programming, development, maintenance and support and the providers of analytics and web font services mentioned above).
  • Fiduciary companies, auditors, lawyers.
  • Persons authorised by us (such as employees entrusted with the processing).
  • Third parties with whom we intend to enter into discussions and negotiate any mergers, acquisitions, divestitures, transfer or pledging of assets, cooperations, participations, partnerships and any similar transactions and relationships, including consultants retained by us in order to enable and support such discussions and negotiations.
  • Other users of the RapMed Service.
  • Other recipients with your permission, or if this is necessary to enforce our rights, in particular to enforce claims arising from the relationship with you.

Third parties may be located in Switzerland, in the European Union (EU), in the EEA or in a third country outside of Switzerland or the European Union/EEA.

Currently, this website and the RapMed Service is hosted on servers in the European Union.

9. Is transfer of the data to a third country intended?

Any data you enter in the registration input mask or within the user account of this website or the RapMed Service will be received, processed and stored in Switzerland and/or the EU/EEA as is any personal data.

The data may be transferred within and between Switzerland and the EU/EEA.

Your data may be transferred to and accessed from a country outside of Switzerland and the EU/EEA (third country),

i. if, as applicable, there exists an applicable adequacy decision of the European Commission or the Swiss Federal Data Protection and Information Commissioner/Federal Council for such a third country;

ii. if we have provided appropriate safeguards for such a third country, in particular by ensuring an adequate level of protection by means of recognised standard contractual clauses or by means of recognised binding corporate rules. In such a case you can request a copy of such contractual safeguards from the controller mentioned in Section 2 above, including by e-mail to [insert appropriate email address]. However, we reserve the right to black out corresponding copies for reasons of protection of secrets or to make them available only in part;

iii. if the transfer is necessary for the performance of a contract between you and us;

iv. if you have explicitly consented to the proposed transfer to and access from a third country or a third party after having been informed of the possible risks of such transfers due to the absence of an adequacy decision and appropriate safeguards.

10. How long will your data be stored?

We process and store personal data for the time necessary to achieve the respective purposes or for the time for which you have granted permission. In addition, we process or store personal data in order to comply with statutory storage and documentation obligations, such as in the case of retention periods required by trade or tax regulations, or if our legitimate business interests so require (in particular to assert, exercise or defend legal claims).

11. What data protection rights can you assert as a data subject?

Once you have access to your user account, you can check and change your details at any time via password-protected access or delete your user account completely.

Using the address mentioned in section 3 above, you can request information about data stored concerning your person. In addition, under certain circumstances you may request the correction or deletion of your data. The deletion of your personal data will be completed, unless we are legally obligated to store the information. You may further have a right to receive the information you have provided in a structured, commonly used, machine-readable and interoperable format.

If we process your data to pursue legitimate interests, and depending on applicable law, you may object to such processing for reasons arising from your particular situation. We will then no longer process your personal information, unless we can demonstrate compelling legitimate grounds for its processing that outweigh your interests, rights and freedoms, or the processing is intended to assert, exercise or defend legal claims.

If the processing is based on consent, you have the right to withdraw your consent at any time. However, this withdrawal will not affect the lawfulness of the processing carried out on the basis of consent before your withdrawal or the lawfulness of processing that is carried out on other legal bases.

Without prejudice to any other administrative or judicial remedy, you may have the right of appeal to a supervisory authority, in the state where you reside, work or where the infringement is suspected, if you believe that the processing of personal data that concerns you is in contravention of applicable data protection law.

12. Necessity of providing personal data

You are free to provide your personal data or not. However, as mentioned above, the provision of personal data is in particular required for opening a user account and for access to and use of the RapMed Service. This means that if you do not provide us with the required personal data, we will not be able to, among other things, open, operate and maintain your user account, grant you access to the RapMed Service or provide any other services.

13. No decision based on automated processing

The RapMed Service and its underlying technology do not subject you to a decision which is based solely on automated processing that produces legal effects concerning you or that similarly affects you.

14. Security

We deploy technical, contractual and organisational security measures to protect the information you have made available from being manipulated, lost, destroyed or accessed by unauthorized persons. Where personal data is being collected and processed through this website and the RapMed Service, the information will be transferred in encrypted form in order to prevent misuse of the data by a third party.

Our security measures are continuously reviewed and revised in line with the latest technology.

We endeavour to ensure that the information on this website and in the RapMed Service is correct, but we do not undertake any obligation to ensure this, nor do we guarantee that the content is complete, correct and up-to-date and/or that this website and the RapMed Service and their content will remain accessible.

This website and the RapMed Service may contain links to other websites. We assume no responsibility for the content of linked websites or for their data protection standards.
